Personal accounts are to be used by the primary owner only. Account holders are not permitted to resell, store or give away web-hosting services from their web site to other parties.
Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
HostPromo Inc. reserves the right to refuse service and/or access to its servers to anyone.
HostPromo Inc. does not allow any of the following content to be stored on its servers:
. Illegal Material - This includes copyrighted works, commercial audio, video, or music files and any material in violation of any Federal, State or Local regulation.
. Online/Offline Games and Anime Sites - Includes all online/offline Casinos, Jumpling, MUDs, Egg Drop, interactive gaming on our servers, Anime, Communities, PlayStation games Forums, news, reviews.
. Hate material - We define hate material as that which expresses or promotes hatred against groups of people. For example, racist, anti-Semitic, material targeting a particular religion or homophobic material are considered to be hate material. We reserve the right to identify hate material for what it is (including identifiers on member sites).
. Portals - Includes any size portal for any purpose (PHPNuke, PosNuke,..).
. Warez - Includes pirated software, ROMS, emulators, freaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
. Streaming Media (regular hosting accounts only) - We do not allow any kind of streaming media, legal or illegal, including Real Audio, Real Video, and QuickTime. The use of Flash/Shockwave, however, is allowed.
. Invalid or Non-Transferable Domains - Every account must have a properly registered domain name, which resides on our domain name servers, within 30 days of the account's opening. After 30 days, accounts without registered or transferred domain names will be terminated automatically. No warnings will be given, and any payments already made will be forfeited. No refunds will be given.
High bandwidth usage: HostPromo Inc. offers an unlimited use policy by maintaining very high bandwidth-to-customer ratios. In rare cases, HostPromo Inc. may determine that a customer is using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, HostPromo Inc. reserves the right to invoke the High Resource User Policy.
You may run any CGI or non-CGI scripts you desire. However, we reserve the right to disable any script that dramatically affects server performance.
Currently, we do not allow IRC or IRC bots to be operated on our servers.
We are proud to offer our clients non-restricted data transfer. This is defined as any transfer of data in the form of text or graphics, directly readable by a web browser. Our intention is to provide a large storage space to serve web documents, not an off-site storage area for electronic files. All image files (.GIF, .JPEG, .BMP, etc.) stored in an account on our servers must be 'linked' to web pages (.htm, .html) which reside within the same account. Accounts containing numerous or large (over 500Kb) unlinked files are subject to warning, suspension or cancellation at the discretion of HostPromo Inc.'s administration.
Please note that over 85% of our clients never exceed even 2000 megs of total FTP and web page transfer combined, so you can be assured that our bandwidth is not choked by numerous 'load-heavy' sites. To further protect the integrity of our service, any individual site consistently using 10% or more of the system's resources may be issued a warning or have its account deactivated.
Resources are defined as bandwidth and/or processor utilization. HostPromo Inc. may implement the following policy at its sole discretion:
When a web site is found to be monopolizing the resources available, HostPromo Inc. reserves the right to suspend that site immediately. This policy is implemented only in extreme circumstances and is intended to prevent the misuse of our servers.
All accounts are set up on a prepay basis. Although HostPromo Inc. reserves the right to change the price of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will be notified before the end of their prepay period to remind them to renew their accounts.
In situations where the card number on file is declined, HostPromo Inc. will immediately suspend the customer's ability to purchase services on-line until the outstanding charge is processed successfully. In addition, HostPromo Inc. reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed from the time the account is established to the time that the customer sends a written cancellation request.
To reactivate a suspended account (due to payment problem) a $15.00 reactivation fee must be paid for each suspended domain/account.
No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically. Payments are accepted in US dollars only.
At this period of promotion, it is only intended for new customers. For existing customers there will be no downgrades or upgrades for our hosting packages which is on promotion.
All hosting accounts are not downgradable until your subscription ends or when the promotion ends.
All hosting accounts are upgradable at any time but not on promotional period.
In order to streamline our accounting procedures and keep costs down HostPromo Inc. accepts Mastercard, Visa (not Visa electron), Discover, American Express and PayPal.
HostPromo Inc. reserves the right to cancel the service at any time. Customer refund requests are to be sent to sales@hostpromo.net and will only be processed in the cases of service non-performance where HostPromo Inc. is clearly at fault. Refund requests for problems beyond HostPromo Inc.'s control will be refused. For example:
. Domain transfer failure.
. Failure of any third party script or program that's not supported by HostPromo Inc.
. A customer's lack of experience in dealing with web basics and communication protocols.
Customer agrees that it shall defend, indemnify, save and hold HostPromo Inc. harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against HostPromo Inc., its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless HostPromo Inc. against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with HostPromo Inc.'s server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from HostPromo Inc.'s server.
HostPromo Inc. will not be responsible for any damages your business may suffer, HostPromo Inc. makes no warranties of any kind, expressed or implied for services we provide. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by HostPromo Inc. and its employees.
HostPromo Inc. reserves the right to revise the above mentioned policies at any time. |
